<p>The ongoing legal battles between the Atlantic Coast Conference and Florida State reached a new point this week, as the conference filed a lawsuit alleging the Seminoles breached a contract.</p>



<p><a href="https://x.com/PeteThamel/status/1747800246078386360?s=20">According to Pete Thamel of ESPN</a>, the ACC seeks damages from Florida State &#8220;for serial breaches of critical legal promises and obligations,&#8221; and also &#8220;questioned FSU&#8217;s right to have leadership in ACC positions.&#8221;</p>

<p>In an amended complaint, the ACC stated &#8220;Florida State has chosen to breach its contractual obligations. It has violated its contractual promise not to challenge the validity or enforceability of the Grant of Rights,&#8221; <a href="https://x.com/PeteThamel/status/1747745242139308468?s=20">according to Thamel</a>.</p>



<p><a href="https://saturdayglory.com/2023/12/22/reports-florida-state-moves-to-file-lawsuit-against-acc-grant-of-rights/">In December 2023</a> Florida State moved to file a lawsuit and &#8220;sue the ACC to challenge the legality of the league&#8217;s grant of rights and its $130 million withdrawal fee.&#8221;</p>



<p>Florida State has considered leaving the ACC with concerns over distribution of revenue. <a href="https://saturdayglory.com/2023/08/03/florida-state-could-very-seriously-consider-leaving-acc-due-to-revenue-distribution-challenges/">In August 2023</a> the Seminoles &#8220;very seriously&#8221; considered departing the conference during a board of trustees meeting.</p>

<p><a href="https://apnews.com/article/florida-state-acc-lawsuit-ff75ebe41dc03d7d60515c220020f326">According to The Associated Press</a>, the ACC also accuses Florida State &#8220;of releasing confidential information — trade secrets between league and television partner ESPN — in its legal filing in the Sunshine State.&#8221;</p>



<p>The ACC&#8217;s filing is 55 pages long and seeks &#8220;a trial and damages it reasonably believes will be substantial,&#8221; according to the AP.</p>



<p>The ACC filed six claims in its lawsuit, &#8220;including FSU breaching its contract with the ACC, breaching confidentiality in the media rights agreement and breaching fiduciary obligations and obligations of good faith,&#8221; <a href="https://www.espn.com/college-sports/story/_/id/39331484/acc-court-filing-accuses-fsu-breach-contract-seeks-damages">according to Thamel</a>.</p>

<p>The lawsuit &#8220;also challenges FSU&#8217;s ability to have school officials in conference leadership positions,&#8221; according to ESPN.</p>



<p>The suit also asks for &#8220;a permanent injunction barring Florida State from participating in the management of the affairs of the Conference while it has a direct and material conflict of interest&#8221; with the conference&#8217;s objectives,&#8221; according to ESPN.</p>



<p>Feb. 16 will be when both sides have agreed to respond to the initial filings, and the overall legal process is &#8220;expected to take years,&#8221; according to ESPN.</p>

<p>A recent vote among Atlantic Coast Conference presidents determined that Pac-12 Conference programs Cal and Stanford will not become members through realignment.&nbsp;</p>



<p><a href="https://www.espn.com/college-sports/story/_/id/38175003/florida-state-4-acc-schools-adding-cal-stanford" target="_blank" rel="noreferrer noopener">According to Andrea Adelson of ESPN</a>, Clemson, Florida State, North Carolina and NC State oppose the additions of the pair of Pac-12 schools.&nbsp;&nbsp;</p>



<p><a href="https://www.si.com/college/2023/08/10/four-to-five-acc-programs-against-stanford-cal-smu-expansion-plan-per-report" target="_blank" rel="noreferrer noopener">According to Joseph Salvador of Sports Illustrated</a>, the number of ACC schools opposed to the expansion effort could be as many as five.</p>



<p>At least 12 ACC programs must vote in support of Cal and Stanford joining the conference in order for it to take effect.</p>



<p>The Pac-12 has been left with four programs — Oregon State and Washington State are the other two — after five teams announced plans to depart for the Big Ten or Big 12 conferences.&nbsp;</p>



<p>The ACC reportedly hit “<a href="https://saturdayglory.com/2023/08/10/reports-acc-hits-roadblocks-on-way-to-potential-expansion-of-cal-stanford/" target="_blank" rel="noreferrer noopener">roadblocks</a>” in discussions earlier in the week about possible expansion to include Cal and Stanford. Concern for “a significant value add” is among the reasoning, according to Pete Thamel of ESPN.&nbsp;</p>



<p>Florida State University President Richard McCullough <a href="https://saturdayglory.com/2023/08/03/florida-state-could-very-seriously-consider-leaving-acc-due-to-revenue-distribution-challenges/" target="_blank" rel="noreferrer noopener">said during a board of trustees meeting Wednesday</a> that the Seminoles could consider even leaving the ACC over revenue distribution concerns.&nbsp;</p>



<p>Any program that expects to depart the ACC must notify the conference by Tuesday, according to Adelson.&nbsp;</p>



<p>Adelson also reported that “it should be noted that the four schools that are opposed (to adding Cal and Stanford) are among a group of seven schools that have had separate discussions looking at the ACC grant of rights and a path forward.” There have reportedly been meetings among programs about whether expansion fits the conference.&nbsp;</p>



<p>There is currently no call or meeting scheduled among ACC presidents to reconvene centering around expansion, according to Adelson, though one could be scheduled at any time.</p>

<p>It may not be long before the Mountain West Conference joins in on recent expansion and conference realignment.&nbsp;</p>



<p><a href="https://www.espn.com/college-sports/story/_/id/38169310/mountain-west-mulls-next-move-acc-decides-cal-stanford" target="_blank" rel="noreferrer noopener">According to Kyle Bonagura of ESPN</a>, there “is a widespread expectation that Oregon State and Washington State would move to the MWC” if Cal and Stanford move from the remaining Pac-12 Conference into the Atlantic Coast Conference.&nbsp;</p>



<p>On the other hand, if the ACC doesn’t expand and add Cal and Stanford from the Pac-12, then it becomes less clear according to Bonagura.&nbsp;</p>



<p>Bonagura reported that Mountain West commissioner Gloria Nevarez said the conference will be ready to go in a direction that results from what the ACC does and what Cal and Stanford decide for their futures.&nbsp;</p>



<p>The ACC hit “<a href="https://saturdayglory.com/2023/08/10/reports-acc-hits-roadblocks-on-way-to-potential-expansion-of-cal-stanford/" target="_blank" rel="noreferrer noopener">roadblocks</a>” on its way to potentially adding Cal and Stanford earlier this week. The reasoning for the obstacles ahead of the conference may’ve been due to the weight of adding such programs and even possibly Southern Methodist University of the American Athletic Conference.&nbsp;</p>



<p>Nevarez told Bonagura that “a lot of it is just trying to sort fact from fiction” and working with conference leaders to determine the best course of action for the Mountain West.&nbsp;</p>



<p>Among the remaining possibilities <a href="https://saturdayglory.com/2023/08/05/reports-pac-12-could-merge-with-mountain-west-conference/" target="_blank" rel="noreferrer noopener">could also include the Pac-12 merging with the Mountain West</a>. The Mountain West is “receptive” to this potential pairing according to Ross Dellenger of Yahoo! Sports.&nbsp;</p>



<p>Another route could be the Mountain West expanding to include Cal and Stanford in all sports other than football, according to Bonagura.&nbsp;</p>



<p>Bonagura also reported there is “almost no chance” that nine of the 12 programs in the Mountain West vote to dissolve the conference and rid each program of the required $34 million buyout.</p>

<p>The Atlantic Coast Conference is trying its hand at getting involved in conference expansion.&nbsp;</p>



<p><a href="https://twitter.com/PeteThamel/status/1689453277094588416?s=20" target="_blank" rel="noreferrer noopener">According to Pete Thamel of ESPN</a>, ACC presidents met Wednesday, and their discussions about adding Cal and Stanford from the Pac-12 Conference “hit significant roadblocks” and among the reasons could be “because there wasn’t ever a significant value add.”&nbsp;</p>



<p>The meeting comes on the heels of reports that the ACC explored the possibility of Cal and Stanford as well as Southern Methodist University joining the conference. The Pac-12 has been left with four member programs since six programs announced departures in the past four weeks.&nbsp;</p>



<p><a href="https://twitter.com/ADavidHaleJoint/status/1689266214399254528?s=20" target="_blank" rel="noreferrer noopener">According to David Hale</a>, during the day Wednesday the ACC continued “to seriously evaluate adding Cal, Stanford &amp; SMU.”&nbsp;</p>



<p>Thamel reported conversations surrounding SMU’s addition from the American Athletic Conference “<a href="https://twitter.com/PeteThamel/status/1689453278944190465?s=20" target="_blank" rel="noreferrer noopener">aren’t headed anywhere</a>.”&nbsp;</p>



<p>Whether the issues halting momentum deal with revenue distribution or logistics, the ACC seems to be gearing up for involvement in recent conference expansion. However, that also appears to be put on hold.&nbsp;</p>



<p><a href="https://twitter.com/LarryWilliamsTI/status/1689456397518331910?s=20" target="_blank" rel="noreferrer noopener">According to Larry Williams of TigerIllustrated.com</a>, the ACC is not going to move forward with expansion and it “sounds done.”</p>
